Prosecutorial Fail: Why George Zimmerman Walked

The State of Florida vs. Zimmerman (Zimmerman) will continue to baffle legal scholars and court observers for years to come. This is a truly historic case. Unfortunately, Zimmerman will be historic for all the wrong reasons. It will be known both as a symbol of justice and injustice. How is that so? Some will point to this case as evidence of the bias that permeates the justice system and others will state the jury has spoken. The sad truth is both sides are correct.  Both sides are correct because George Zimmerman may not have been guilty of second-degree murder but he is guilty of a crime. Notwithstanding the criminal profiling that obviously took place prior to the chase, one could possibly make an argument that the facts and the evidence did not support Zimmerman had any ill-will, spite or hatred toward Trayvon. Nevertheless there was a crime committed and facts show that Zimmerman would be guilty of felony murder. Allow me to make my case.

Approximately a week ago I, the author, attended the “Under a Microscope: Stand Your Ground Gun Law” symposium, sponsored by First Choice and produced by The Orange County Bar Association Paralegal Section. The event was moderated by Paul Owens of the Orlando Sentinel and consisted of a three-person panel: Senator David Simmons Esq., one of the sponsors of Florida’s Stand Your Ground Law; the Honorable Bob LeBlanc; and Zahra Umansky Esq. The event was eye-opening to say the least and the balance was tipped. In fact there was only one slide under the microscope – the slide provided by the gun lobby – and it prompted me to write this article.

George ZimmermanThe surveillance video that was recently released by the Sanford Police Department showing Zimmerman in handcuffs without visible blood on his shirt, face, nose or head has caused most objective observers of this controversy to begin to doubt Zimmerman. In fact the video reveals no visible injury to his person. Yet this is not the issue and Zimmerman, even with the release of this video, still has a strong defense. (more…)
